1) About Variété.ist

2) Scope
These Terms apply to all offers, orders, and purchases made via the Variété.ist website (“Website”). By placing an order, the customer agrees to these Terms. Mandatory consumer protection rules in the customer’s country of residence may also apply.
3) Products
Variété.ist sells original artworks, limited editions (including giclée editions and screen prints), bundles/series, and (on request) frames and commissions/custom work.
Edition sizes are limited per artwork (typically max. 25 or 50). Every sold artwork includes a Certificate of Authenticity (CoA).
4) Product information and handmade variations
Artworks and frames are handmade. Natural variations in wood grain, finish, color tone, and minor dimensional tolerances may occur. Product photos aim to be accurate, but colors may differ due to screen settings and lighting.
Materials may vary; specifications shown on the product page are leading.
Unless explicitly stated on the product page, frames are not included.
5) Prices and currency
Prices are shown in EUR / GBP / USD / CHF / DKK (as available on the Website). Prices include VAT where applicable, unless stated otherwise. Any bank/provider fees (e.g., currency conversion) are the customer’s responsibility.
6) Payment
Payment is completed at checkout via Squarespace. Available methods shown at checkout may include credit/debit cards, Apple Pay, and Google Pay (depending on device/location/provider). The purchase is final once payment is successfully completed.
7) Order confirmation
A purchase contract is formed when payment is received and the order confirmation email is issued. Customer cancellations are not possible after purchase, except where statutory withdrawal rights apply (see Section 10).
8) Free worldwide shipping
Shipping is free worldwide. Orders are typically prepared for dispatch within 5 business days. Delivery times vary by destination and carrier. Shipments include track & trace.
For deliveries outside the EU: import duties, local taxes, and customs fees are the customer’s responsibility.
9) Insurance, risk, and ownership
All shipments are insured up to the declared value.
For consumers, risk passes on delivery/receipt by the customer (or a designated third party). Ownership transfers after full payment.
10) Damage during transport
Report damage to info@variete.ist:
Visible damage: within 48 hours of delivery
Hidden damage: as soon as discovered, preferably within 5 days
Include photos of the box (all sides), protective materials, and the artwork/frame. Keep all packaging until the claim is resolved.
11) Withdrawal / returns (consumers)
11.1 EU/EEA consumers
EU/EEA consumers generally have a 14-day right of withdrawal, starting the day after goods are received, without giving a reason.
11.2 Outside EU/EEA (voluntary policy)
Customers outside the EU/EEA receive a voluntary 14-day return policy on the same conditions below, unless excluded in Section 12 or prohibited by local law.
11.3 How to withdraw
Email info@variete.ist within the applicable period with the order number, product(s), and a clear statement of withdrawal. Return instructions and the return address will be provided by email.
11.4 Return conditions
Goods may be handled only as in a physical store to assess them. If handling goes beyond that, diminished value may be charged. Returns must be in original condition and, where reasonably possible, with original protective packaging.
If protective packaging includes a seal, keeping it intact supports “as-new” condition. If packaging or the work shows handling beyond necessary inspection, a deduction may apply.
Bundles/series must be returned complete unless agreed otherwise in writing.
11.5 Costs and refunds
Return shipping is at the customer’s cost unless the return is due to proven damage or an error by Variété.ist. The customer bears return-shipping risk until Variété.ist receives the return.
Refunds are made via the original payment method. Variété.ist may withhold the refund until the return is received or proof of return is provided. Returns are processed promptly after receipt; Variété.ist aims to process within 5 business days.
12) Withdrawal exclusions
Withdrawal does not apply to:
Commissions and custom/personalised works
Custom framing / made-to-measure framing
Specific custom terms may be confirmed in writing by email and form part of the agreement.
13) Certificate of Authenticity (CoA)
The CoA is valid only when accompanying the artwork and may be transferred together with the artwork.
14) Resale and verification
Resale is permitted. Copyright remains with the artist (see Section 15). Verification may be requested via info@variete.ist with supporting photos and CoA details.
15) Intellectual property
All copyrights remain with the artist. Personal, non-commercial sharing is allowed (credit appreciated).
Without prior written permission, customers may not reproduce, distribute, scan, commercially exploit, use for AI training/datasets, create merchandise, or otherwise commercialize the artwork.
16) Liability
To the maximum extent permitted by law, Variété.ist is not liable for indirect or consequential damages. Liability is limited to the order amount or the insured value of the shipment (where applicable), unless mandatory law provides otherwise.
17) Force majeure
Variété.ist is not liable for delays or failure caused by events beyond reasonable control (e.g., carrier disruptions, strikes, fire, accidents, serious illness).
18) Complaints and ADR
Complaints: info@variete.ist. Variété.ist aims to respond and resolve issues as soon as reasonably possible. Where available, consumers may use an applicable ADR body in their country.
19) Governing law
These Terms are governed by Dutch law. For consumers, mandatory consumer protection rules of the country of residence may also apply. For business customers (B2B), disputes are submitted to the competent court in the Netherlands.
20) Updates and severability
Variété.ist may update these Terms; the latest version is published on the Website. If any provision is invalid, the remaining provisions remain in effect.
